La real malicia
La famosa "cláusula Parrilli", incorporada entre gallos y medianoche en el artículo 72 del proyecto de reforma judicial enviado por el Ejecutivo, pretendía obligar a los jueces a denunciar ante el Consejo de la Magistratura cualquier intento de influir en sus decisiones por parte de los poderes mediáticos, léase de la prensa libre. Durante su tratamiento en el Senado, fue modificada a solicitud de su autor y el término "poderes mediáticos" fue sustituido por "grupos de presión de cualquier índole", lo que mantiene en pie la amenaza, ahora con un alcance más difuso y, por ende, más amplio y discrecional.
Lo primero que cabe preguntarse es qué consecuencias prácticas tendría dicha cláusula en caso de ser aplicada. ¿El Consejo de la Magistratura promovería una acción penal contra el medio denunciado a través del Ministerio Público? Poco efecto tendría, pues al no estar tipificado en el Código Penal, ese supuesto delito no existe, por lo que la causa moriría nonata. Tampoco cabría una demanda por daños y perjuicios, ya que el Consejo no habría sido perjudicado por las supuestas calumnias o injurias vertidas por el medio en cuestión.
En síntesis, la inclusión de dicha cláusula resulta anodina y, por ende, superflua. Pero lo grave de su incorporación no reside en sus consecuencias prácticas, sino en lo que subyace detrás de ella, que es la exhibición del desprecio de su autor (o autora) por las garantías constitucionales. Acaso fuera tan solo una prenda de canje para entregar a cambio de la inclusión de otras cláusulas, o un anticipo de su autor (o autora) acerca de sus intenciones de avanzar sobre la libertad de expresión, lo que nos obliga a encender una luz de alarma.
El derecho de publicar las ideas por la prensa sin censura previa está consagrado en el artículo 14 de nuestra Carta Magna, a lo que los constituyentes añadieron una salvaguarda adicional en el 32, que prohíbe expresamente al Congreso de la Nación "dictar leyes que restrinjan la libertad de imprenta o establezcan sobre ella la jurisdicción federal". Con ello procuraron impedir que, al ejercer su potestad legislativa, el Parlamento ponga trabas al libre ejercicio de un derecho que hace a la esencia misma de la democracia republicana, sobre todo en cuestiones de interés público.
La Corte Suprema ha sentado además jurisprudencia en varias sentencias acerca de la procedencia de una demanda efectuada por un funcionario público contra un medio de prensa, con motivo de una manifestación falsa y difamatoria referente a su conducta. El doctor Luis Zarazaga explica que en el caso Campillay, a través del fallo del doctor Fayt el tribunal ha aplicado la llamada "doctrina de la real malicia", según la cual la condición para que una demanda como esa proceda, es que se pruebe que la manifestación fue hecha con dolo real, es decir, con conocimiento de que era falsa o con una temeraria despreocupación acerca de su verdad o falsedad.
La mencionada doctrina está tomada de un fallo de la Suprema Corte de los Estados Unidos del 9 de marzo de 1964, en la causa New York Times Co. and Abernathy, Ralph D. y otros, vs. Sullivan, L.B. Con ello ambas cortes han querido dejar claramente establecido que "debe reputarse esencial manifestación del derecho a la libertad de prensa el ejercicio de la libre crítica a los funcionarios por razón de actos de gobierno, ya que eso hace a los fundamentos mismos del régimen republicano".
Si la Corte argentina mantiene ese criterio, cualquier intento de vulnerar el derecho de expresión encontrará en ella su freno. Pero para que así ocurra y la libertad de prensa continúe protegida, debemos estar atentos para impedir cualquier avance sobre la independencia del Poder Judicial, que intente ponerlo al servicio de intereses reñidos con el bien común y la vigencia del sistema republicano de gobierno. Ese es el gran peligro que entraña la reforma que pretende la vicepresidente, para quien el proyecto en tratamiento es insuficiente, pues a su criterio el país "todavía se debe una verdadera reforma judicial", cuyo alcance podemos imaginar.
